These Terms govern the use of the Pilotio service. Pilotio provides software (SaaS) for booking and managing tandem flights. Pilotio does not carry out tandem flights.
1. Roles
Pilotio is operated by Michal Stuchlík, Company ID (IČO) 03868427, Skřečoňská 1334, 735 53 Dolní Lutyně, Czech Republic ("Pilotio").
- Pilotio — the software provider and platform operator. It does not carry out or organise flights, does not guarantee that they take place or that they are safe, and is not a party to the relationship between pilot and passenger.
- Pilot / company — the tandem pilot or company that uses Pilotio to offer and provide the flight itself. It is responsible for qualifications, authorisations, licences, insurance, lawful operation and the safe conduct of the flight.
- Passenger — a customer of the pilot / company. The contract for the flight is between the passenger and the pilot / company.
2. Account, eligibility and who uses Pilotio
An account may be created by a person over 18. On registering, the person undertakes to provide true and current information, to keep login credentials secure, and is responsible for activity under their account, including any other person they allow to access it.
Pilotio is designed primarily for tandem pilots, instructors, schools and operators using the service in connection with their professional or business activity in tandem flying or training — but not only for them. An account may also be created by an individual who does not use Pilotio as part of a business (i.e. as a consumer), and equally by a person who, within a Company account, only manages or administers a team of pilots without flying themselves — neither use is excluded as a condition of creating an account, and nobody confirms a false declaration about their own status when registering. Where a user genuinely is a consumer, they hold all the rights consumer-protection law mandatorily gives them (including the right of withdrawal under section 18), regardless of what the service's typical intended use is otherwise described as; provisions of these Terms intended solely for professional/business users do not apply to that consumer to the extent they would conflict with those rights.
By creating an account you confirm that you have read and accept these Terms, the Privacy Policy and the Data Processing Agreement (DPA).
3. Pilot responsibility
The pilot / company is solely responsible for:
- their qualifications, authorisations and licences to operate tandem flights,
- insurance covering the operation and the flight,
- the legal permissions required to run the aviation/sporting activity,
- operational safety, equipment and its airworthiness,
- assessing the actual local conditions and deciding whether a flight takes place (go/no-go),
- the lawful processing, as controller, of passenger personal data collected through Pilotio,
- compliance with the applicable aviation regulations and local law,
- the passenger's briefing and safety, and settling price, payment and any cancellation with the passenger.
Pilotio does not take part in these decisions, and merely allowing an account to use the platform does not certify or independently verify any of the above.
4. Acceptable use
Pilotio must not be used for unlawful activity, including operating tandem flights without the required qualifications, authorisations, licences or insurance, to circumvent security features, to place an undue load on the infrastructure, for automated data scraping beyond normal use, or to interfere with the rights of third parties. A user must not enter data for which they have no legal basis to have it processed.
5. Plans and subscriptions
Pilotio currently offers individual plans (Free, Basic and Pro) and a Company plan for tandem companies and schools. Current prices, limits and feature scope are always shown authoritatively in the app (Plan overview) — these Terms do not repeat specific prices, so they cannot fall out of step with the current offering.
- Free: the free individual plan. A newly created account starts on it automatically. Free includes a one-time limit on reservation requests created for the lifetime of the account (currently 15) — every created reservation counts toward this limit regardless of its later status (pending, confirmed, flown, no-show, or cancelled), not only a reservation for which a flight was ultimately confirmed. The limit is never reset by downgrading, upgrading, or otherwise changing plans.
- Basic, Basic+, Basic++: paid individual plans with progressively greater limits and features.
- Pro: a paid individual plan with the greatest scope of features and limits.
- Company: a paid plan for a tandem company or school, with up to 5 pilot seats, including shared reservation management, a public online booking page, and Pro-level features for each pilot who occupies a seat within the company.
Paid plans (both individual and Company) are agreed as a recurring subscription in CZK or EUR, as chosen by the subscriber, with a monthly or annual renewal period as selected; the subscription renews automatically until the subscriber cancels it. Payment is handled by the payment service provider Stripe. Cancellation is possible at any time in subscription management; the subscription and the paid plan's scope stay active until the end of the already-paid period, after which it does not renew.
For an individual plan, the account then moves to the Free plan — no data or history is lost. For the Company plan, the company loses the ability to create new bookings and loses its public online booking page; existing reservations, their history, and their management remain available, and no data is deleted. Renewing the subscription restores the Company plan's full scope.
If a recurring payment cannot be processed, the standard payment-retry process configured at the Stripe payment gateway runs; the paid plan stays active for the duration of that process. Once that process concludes as unsuccessful, an individual plan moves to Free and a Company plan is restricted as described above — the exact length of this process depends on the payment gateway's own configuration, not on a fixed period set by Pilotio itself.
Pilotio may change the prices of paid plans; for an existing subscription, a change takes effect no earlier than the next billing period and is announced with reasonable notice. Pilotio is not a VAT payer, so prices do not include VAT; a tax document for the payment is issued by the payment service provider or by Pilotio depending on the payment setup.
The Free plan is provided "as is" and Pilotio may change or discontinue it with reasonable notice.
6. Payments
Payments for paid plans (both individual and Company) are processed by a payment service provider. Prices are shown for each plan. Money between passenger and pilot/company for the flight itself and for a voucher extension is handled outside Pilotio — Pilotio does not charge, refund, or otherwise process it; Pilotio does not accept any payment from passengers for flights.
7. User-provided content
A pilot enters their own content and data into Pilotio (profile, photos, offers, takeoff sites, notes, client data) and is responsible for its content, accuracy and the right to use it. The pilot grants Pilotio a limited right to process and display that content to the extent necessary to operate the service. Pilotio claims no ownership of user-provided content.
8. Intellectual property
Pilotio, its software, design, name and the slogan "Less work, more fun." belong to the operator. The user obtains a non-exclusive, non-transferable right to use the service for the duration of a valid account. The user does not acquire the source or object code of Pilotio. Third-party components remain subject to their own licences.
9. External services
Pilotio uses external providers (hosting, database and authentication, storage, e-mail sending, payments, the weather forecast service, the public takeoff-site database). An outage or a change of their terms may affect how Pilotio works.
10. Availability
Pilotio aims for high availability but provides the service without a guarantee of uninterrupted operation. There may be planned downtime, maintenance and outages. Pilotio is not liable for damage caused by unavailability beyond mandatory law.
11. Weather — limitation of decision support
Weather information in Pilotio is forecast-based decision support.
- The forecast does not guarantee suitable conditions and actual conditions may differ from it.
- Pilotio does not approve, certify or declare a flight to be safe. No colour status (green / yellow / orange / red) means "safe" or "cleared to fly" — it only expresses how the forecast matches the configured criteria.
- The final decision on whether a flight takes place is always made by the pilot based on the actual local conditions, legal requirements and their professional judgment.
- Existing confirmed bookings are not cancelled automatically because of a forecast status.
12. Suspension and termination of an account
Pilotio may suspend access to an account or terminate it, in particular in the event of:
- suspected unlawful activity carried out through the account,
- abuse of the service or a security risk to Pilotio or other users,
- repeated non-payment of a subscription,
- a serious breach of these Terms.
Where circumstances realistically allow it (i.e. there is no urgent security reason), Pilotio gives reasonable advance notice of a suspension or termination and an opportunity to remedy the situation. A user may close their own account at any time.
13. Data after account termination
After a pilot's account is terminated, Pilotio will, at the pilot's choice, delete the passengers' data or make it available on request, as set out in more detail in the Data Processing Agreement (DPA), except to the extent Pilotio is required to retain it under applicable law (e.g. accounting and tax law).
Pilotio does not currently offer a self-service bulk data export feature — a pilot can request access to or deletion of their data at support@pilotio.eu. This paragraph will be updated if Pilotio introduces self-service export in the future.
14. Limitation of Pilotio's liability
The following limitation applies to the maximum extent permitted by the law governing these Terms under Section 16, and does not apply where it would conflict with mandatory law.
- Pilotio is not liable for indirect damage, lost profit, data loss caused by circumstances outside Pilotio's reasonable control, or other consequential damage arising in connection with use of the service.
- Pilotio's total liability to any one pilot/company for all claims arising in connection with the service in a calendar year is limited to the amount that pilot/company actually paid Pilotio in subscription fees in the preceding 12 months.
This limitation does not apply to liability that cannot be limited or excluded under mandatory law, to damage caused by Pilotio's intentional misconduct or gross negligence, or to personal injury or loss of life caused by Pilotio's fault where such a limitation is not permitted by law.
15. Pilot's liability towards Pilotio and third parties
A pilot / company is liable to Pilotio for damage and third-party claims (including from passengers) arising from:
- the pilot's/company's provision of tandem flights or related services,
- the pilot's/company's missing or invalid qualifications, authorisations, licences or insurance,
- the pilot's/company's unlawful entry or use of passenger personal data,
- content the pilot/company enters into Pilotio,
- the pilot's/company's breach of applicable law,
except to the extent the claim was caused by Pilotio's own breach of its obligations or wrongful conduct.
16. Governing law and jurisdiction
These Terms and the relationship between a user and Pilotio are governed by the law of the Czech Republic, excluding its conflict-of-laws rules. The general courts of the Czech Republic, with local jurisdiction based on the operator's seat (Skřečoňská 1334, 735 53 Dolní Lutyně, Czech Republic), have jurisdiction to resolve disputes.
This choice concerns the relationship between a professional/business user and Pilotio and does not exclude the protection that mandatory law of the user's country of residence or habitual residence grants them as a consumer or in relation to data protection, where such law is applicable and cannot be contractually excluded.
17. Changes and language version
Pilotio may develop and change the service and change these Terms; material changes will be announced in advance in an appropriate way. By continuing to use the service after a change takes effect, the user accepts it; a user who does not agree may close their account. The current internal version of this document is v2.
These Terms are drawn up in Czech and in English. In the event of a discrepancy between the language versions, the Czech text prevails; the English version is provided for the information of users who do not read Czech.
18. Right of withdrawal and out-of-court consumer dispute resolution
This section applies only to a user who subscribes as a consumer, i.e. outside the scope of their trade, business, or profession (see section 2) — it does not apply to a user acting as a business or in a professional capacity.
Under section 1829 of the Czech Civil Code, a consumer has the right to withdraw from a subscription contract concluded by distance means within 14 days of its conclusion, without giving any reason — this right survives paying for and activating the paid plan, and activation alone does not automatically extinguish it.
A Pilotio subscription is an ongoing service (access to the software for the subscribed period), not digital content supplied as a one-off — the withdrawal exception for digital content not supplied on a tangible medium (section 1837(l) of the Czech Civil Code) therefore does not apply to it.
When ordering a paid plan in the app, the consumer expressly confirms a checkbox, before completing the order, requesting that Pilotio begin providing the paid plan (grant access to its scope) before the 14-day period expires — merely having read this section is not, by itself, that request; these are two distinct confirmations made together in one checkbox. Access is activated immediately upon successful payment. This request does not, by itself, extinguish the right of withdrawal: under section 1837(a) of the Czech Civil Code, that right is excluded for services only once the service has been fully performed in its entirety, which generally does not happen for an ongoing, recurring subscription. If the consumer withdraws within the 14-day period after provision of the paid plan has begun at their express request, they must, under section 1834 of the Czech Civil Code, pay Pilotio a proportionate part of the agreed price corresponding to the performance provided up to the moment of withdrawal; Pilotio will refund the remaining amount already paid, using the same method it was received, without undue delay.
An unambiguous statement sent to support@pilotio.eu is enough to withdraw, making clear who is withdrawing and from which contract (e.g. the e-mail or name used at registration and the date the paid plan was ordered). The following model text may be used, for example: "I hereby give notice that I am withdrawing from the Pilotio subscription contract concluded on [order date]. Name/e-mail: [...]. Date: [...]." Using this model is not mandatory.
Withdrawing from the contract must be distinguished from merely cancelling automatic renewal of a subscription: cancelling renewal (section 5), available at any time and free of charge, stops future payments and lets the already-paid period run out, without undoing the contract already concluded and performed for that period and without any right to a refund of the amount already paid; withdrawal, by contrast, undoes the subscription contract itself and comes with the proportionate refund described above.
Anything concerning the tandem flight itself (price, payment, cancellation, a replacement slot) is outside Pilotio and is settled directly with the pilot/company — see section 6 and the Booking Conditions. This section concerns only the Pilotio software subscription contract.
A complaint about the Pilotio service itself (not the tandem flight) can be made to support@pilotio.eu. A consumer who has not reached a satisfactory resolution this way may turn to the body responsible for out-of-court consumer dispute resolution: the Czech Trade Inspection Authority (Česká obchodní inspekce), Ústřední inspektorát – oddělení ADR, Štěpánská 567/15, 120 00 Praha 2, Czech Republic, e-mail adr@coi.cz, www.adr.coi.cz.
